Spain has published Royal Decree 952/2026, updating its national framework for biocide registration, manufacture, sale and use. The final text appeared in the official gazette on 6 November 2026. It complements the EU Biocidal Products Regulation and generally takes effect on 1 July 2027.
The decree introduces a transaction register for biocides in specified hazard categories. Obligations cover relevant establishments and biocidal services, as well as professional purchasers applying the products within their own activities.
Products And Transactions Covered
Article 13 covers acute toxicity categories 1–3, category 1 specific target-organ toxicity, category 1A or 1B carcinogenicity, mutagenicity or reproductive toxicity, and category 1 respiratory sensitisation. It also includes category 1 endocrine disruption and the specified persistent, bioaccumulative or mobile hazard classes.
Operators must record their acquisitions, transfers or applications. Required information includes the product and active-substance identifiers, batch, quantity, transaction date, relevant parties and supporting document. The register should preferably be electronic and must remain available to the competent authority. Sales of biocides intended for the general public are excluded from this obligation.
Transition From Existing Movement Books
The third transitional provision allows six months from general commencement to implement the Article 13.2 traceability system. During that period, the existing movement-book rules under Royal Decree 1054/2002 and the 1993 order continue to apply.
The new framework therefore replaces an existing control system. Its preamble explains that the earlier toxic and very-toxic product categories needed updating to reflect EU classification rules.
A separate commencement exception applies to the repeal of the third additional provision of the swimming-pools decree, Royal Decree 742/2013. That repeal takes effect the day after publication, on 7 November 2026.
