Florida Lead and Copper Rule Improvements proposal opens for comment
The Florida Department of Environmental Protection has proposed amendments supporting state implementation of the federal Lead and Copper Rule Improvements. Notices published in the Florida Administrative Register on 6 October 2026 invite comments through 27 October 2026.
The highlighted amendments concern Rule 62-560.620 on bottled water and point-of-use and point-of-entry devices, and Rule 62-555.322 on the prohibition of lead pipe, solder and flux. They form part of Florida's wider incorporation of revised federal requirements in 40 Code of Federal Regulations Part 141, Subpart I.

At federal level, the rule reduces the lead action level to 0.010 milligrams per litre, or 10 micrograms per litre. The copper action level remains 1.3 milligrams per litre. It strengthens sampling by requiring first- and fifth-litre samples at sites with lead service lines and accelerates public notification following lead action-level exceedances.
Service-line planning is the central operational change
Community water systems and non-transient non-community water systems generally must replace lead and galvanised-requiring-replacement service lines under their control within ten years, subject to the rule's limited alternative schedules and deferrals. Systems must maintain and make available inventories and prepare replacement plans by 1 November 2027.
Florida's proposal does not restart or postpone that federal timetable. Water systems should continue inventory validation, customer communication, sampling preparation and replacement planning while the state process proceeds. Contractors and material suppliers should anticipate demand for excavation, replacement components, corrosion-control work and reliable records linking field activity to inventory updates.
Property owners should also confirm how utilities will obtain access and allocate responsibility where privately owned service-line sections require replacement.
