The Health and Safety Executive (HSE) of Great Britain has announced that an active substance vital for biocides is no longer supported within its regulatory framework. The active substance in question, 2,2-dibromo-2-cyanoacetamide (DBNPA) with CAS number 10222-01-2 and EC number 233-539-7, for product type 02, did not receive the necessary dossier to support its inclusion in the GB Review Programme. This development puts the active substance on track for non-approval under the GB Biocidal Products Regulation (GB BPR), separate from the EU Biocidal Products Regulation (EU BPR) which applies in Northern Ireland. This non-approval implies that products containing DBNPA in the applicable product types will ultimately be phased out from the GB market. The HSE is urging anyone with knowledge of potentially significant adverse consequences arising from the non-approval to contact their team by 4 February 2024.‍For more details on the regulation of biocides in GB and this specific case, you can refer to the HSE biocides web page.

Upcoming GB active substance renewal submission deadlines

Those in the biocidal products industry should be aware that the approval of active substances under GB BPR is set to expire if a renewal application is not filed within 550 days prior to the expiration date. Several substances with their respective combination product types face this upcoming deadline:

  • Nonanoic acid (Pelargonic acid) (CAS 112-05-0 EC 203-931-2) in product type 02
     Deadline: 29 March 2024
  • 4,5-Dichloro-2-octylisothiazol-3(2H)-one (DCOIT) (CAS 64359-81-5 EC 264-843-8) in product type 21, alongside several other substances in product type 21
     Deadline: 29 June 2024
  • Copper, granulated (CAS 7440-50-8 EC 231-159-6) in product type 08
     Deadline: 29 June 2025

The entire list of substances and deadlines can be checked on the HSE website.

Stakeholders are reminded that it's not mandatory for only the original supporters to renew a substance; any person, company, or consortium can take up the task. It's crucial for suppliers and users to ensure that their active substances receive timely support to avoid market withdrawal in GB.

Failure to submit a renewal application by the respective deadlines will mean that such active substances will no longer be available for use in biocidal products or treated articles in the relevant product types.
